The 5 Work Comp Errors EVERY Agent Makes

Workers’ compensation, as a coverage, is simple. A worker gets hurt, the work comp policy pays – theoretically; that’s the simple part. The more complicated areas of workers’ compensation involve the state laws and legal doctrines applicable to workers’ comp. Key areas of confusion are:

1. For whom is the insured actually responsible under workers’ comp laws?
2. Who counts as an employee?
3. What happens when employees travel out-of-state to work?
4. When should insured’s experience mod be combined?
5. What are some of the key premium audit problems?

Agents must be able to answer these questions when they arise. But there is much confusion and misinformation surrounding these topics.

This session undertakes to introduce and answer these five questions to help prepare agents to better manage their client’s usual and unusual workers’ compensation exposures.

11:30 am – 1:00 pm
Luncheon & Keynote Address by Sam Glenn, The Attitude Guy – Award winning speaker, performance artist and author.
1:30 pm – 4:30 pm
Contractual Risk Transfer, Additional Insureds and Certificates of Insurance

Your construction insureds enter into contracts almost daily. Do the contractual risk transfer (CRT) and additional insured (AI) requirements generally found in those contracts create a fair and equitable business relationship between the upper tier contractor and your lower-tier insured? What are the goals of CRT and AI status? Should you push back against these requirements or go on about your day and not worry about what you just gave up?

With an understanding of contractual risk transfer (CRT) and the realities of additional insured (AI) status, we can turn our attention to the requirement placed on your insured and YOU that general liability coverage be provided on a “Primary and Noncontributory” (PNC) basis.

Once we understand contractual risk transfer, additional insureds and the primary and noncontributory requirement, we have to turn our focus to certificates of insurance. Because of the CRT, AI and PNC requests/requirements placed on the insured, you will inevitably be faced with inappropriate certificate of insurance requests.

This session addresses each of these concepts giving you insight on what you need to do to protect your client and comply with the contractual requirements without overstepping your authority.
